About

There has been much written and spoken about me concerning my journey through life.  The internet is full of information both true and not true.  I just wanted to give you an overview and brief bio of my life, so that you could receive the information from the source rather than others who do not really know the whole story or truth.  I always believe in full disclosure and I have worked hard in my life to do the right thing for the highest good of all.  This information is now available to you for review and to make your own decisions.  Thank you.

With regard to the convictions listed above…

The best I can do is a brief narrative as I see it.  For many years (9) I was not allowed to state my side of the story because of the contract I had signed with the State of Idaho and Dept. of Corrections.  When I my probation was officially terminated, that censure ended.

In 1997, my wife and I moved our family from Washington State to Idaho, the place of our birth.  We had this crazy notion that we could make a new start there and do some good in the world.  Anyway…

We entered into a partnership (Phytomax) with Wayne Holladay to grow seedstock (mushroom) and sell to farmers in Idaho.  The mushroom was to be used to make a Beta Glucan product.  He showed himself to be a very dishonest and disreputable man and we severed the partnership and counted ourselves lucky.  He continued the business for a short time, but finding that he could not compete without someone on board who had actually grown mushrooms, he quit the endeavor.

We then entered into a partnership (Mountain Top Organics) with  Dave Carpenter to try to continue with what we had begun. Client farmers were obtained in Idaho and Montana.  Mr. Carpenter fired me and took possession of all the company assets.  We were on a limb again.  He also tried to continue in the business but had no experience in the industry and failed.  We continued all alone in a new Idaho State Corporation “Idaho Reishi” and took on a Board constructed of members of the Idaho Reishi Grower’s Association and Counsel.

In 1998, a “Grower’s Cooperative” in Montana came on board and paid for one training course for their growers and $2,000.00 worth of starter seed.  They numbered around twenty growers.  If they had contracted as individual growers (such as with the Idaho Growers) they would have all paid separately for the training ($3,600.00)We had also built a grower base of 26 farms in Idaho.  Mr. Holladay and Mr. Carpenter were a little put out that we were making a success of it, however, and they complained of fraud to the Idaho State Attorney General.  That office filed a “Pre-Trial Settlement” against us and demanded that we pay $100,000.00 or we would sued in civil court.  We said see you there.

Right at the same time as Idaho filed civil action, the Montana Coop showed signs of disintegrating.  Three separate individuals claimed to be “President” of the Coop.  They had received training and were awaiting delivery of their seed.  One of the “Presidents” circulated a fiction that the seed had been lost in an accident which never took place.  The Corporation never contradicted her, but decided to allow the lie to flush out the responsible party.  When Idaho Reishi, Inc. asked them to provide an authorized party and an address, we never heard from them again.

Then the State of Montana pierced the Corporate Veil and surgically took me out and prosecuted me for Theft.  The seed and the training were deemed damages, even though it was discovered in the trial that the “Cooperative” never really existed and that each of the parties had committed fraud in the lie about being a Corporate Cooperative.  This information formed the basis for a motion to dismiss.  Nothing can be “proved” by fraud.  The Coop Members had committed fraud and wanted to use the fraud to prove that Idaho Reishi had committed fraud.  Crazy.  The Judge took an Illinois State Law regarding unofficial associations and made it work for Montana.  Motion Denied!  Make up the Law as you go.  I was convicted and sentenced to two concurrent 10 year terms for a first offense.  The sentence was suspended and I was made to spend thirty days in county jail and go on probation. The probation was officially terminated in 2002.

Because of the Montana conviction, the State of Idaho filed an “Information” of same and I was arrested and convicted of the same incident in the State of Idaho.  I was sentenced to two years, but that judgment was “withheld.”  I served a “Rider” of four months in North Idaho Correctional Institution, a boot camp, and was released on probation.  At the end of the probation period (5 years) the case was DISMISSED as if it never happened at all.

These are the facts of the matter without going into details that would take a great many pages.

Walk Sacred,

Cloudpiler
